Texas Tech University Sexual Misconduct Process

  • When an incident report is received, it gets reviewed by the Title IX Case Management Team who will either refer it to the appropriate office or reach out to the Complainant to offer Supportive Measures. A Complainant can choose to ask only for Supportive Measures or can also file a Formal Complaint which will begin the Grievance Process.
  • Once the Grievance Process starts, an Investigator will meet with the Complainant and will send a notice of Formal Complaint to the Complainant and the Respondent. The Investigator will then meet with both parties individually and any additional witnesses. At the conclusion of the investigation, the Investigator will draft an Investigation Report that contains statements, evidence, and witnesses.
  • The draft Investigation Report will be sent to the Complainant, Respondent, and any advisors for review. They will have 10 business days to make comments to the Investigation Report.
  • After the 10-day review period (and at least 10 business days before the hearing), the Complainant, Respondent, and Advisors will receive the final report. At this time, the Hearing coordinator will begin the Pre-hearing Process and will schedule the Hearing.
  • At any point prior to the Hearing, the Complainant and Respondent may choose to participate in the Informal Resolution process. All parties must agree in writing to participate, agree on the terms, and waive the right to an appeal.
  • Either party may appeal the decision of a Hearing after it is conducted. They will have 3 business days to appeal, and then the other party will have 3 days to respond. The University will then have 5 business days to make an appeal decision.
